Page 52—List of information you need. Adds (ESI) Electronically Stored Information, such as intellectual property, music, writing, art, etc.

Page 55—Code language updated. Familly Code 721(b) language updated—changed the Corporation Code sections referenced in it.

Page 63—Case Management. Adds a section on the new Family Centered Case Resolution procedure.

Page 68—Expedited Child Support. Describes the Expedited Child Support procedure and the forms used.

Page 72—Live Testimony. Adds reference to the new California Rule of Court 5.119.

Page 97—Expiration of Protective Orders. Protective orders for custody, visitation, or support will survive the expiration of any protective order. Family Code 6340(a).

Page 111— Revised list of Domestic Violence forms.

Page 263—Assistants and Support Persons. When seeking a restraining order, this is a right (FC 6303). However, in other cases, you need to ask the judge's permission. If you need to be certain ahead of time, file a motion requesting the presence of a support person for duties similar to those set out in FC 6303.

Page 27, item 5—OSC for Contempt. If money was not paid as ordered for support, attorney fees, court costs, etc., attach FL-411 to describe the facts. For violations of domestic violence orders or child custody/visitation orders, attach FL-412 to describe the facts.

Chapter 15 and other pages. Live testimony at hearings.
Until January 2011, all hearings on motions or OSCs were conducted on written declarations of witnesses and live testimony would be allowed only on a showing of special need. This has been turned upside down in Family Code 217. Now, live testimony of witnesses in court will be allowed if you file a witness list with your other motion or OSC papers. The judge can deny live testimony for a good cause that must be specified and put in the record. This change is reflected in many places in the book, but most particularly in chapters 11D and 15. July 1, expect Rules of Court 5.118 and 5.119 to define this change and the factors a judge must consider before refusing live testimony.

Page 67. New subsection 9G inserted: How to Calculate Deadlines. New Rule of Court 12c clarifies how to count days to figure a deadline before a hearing.

Page 68. New subsection 9J inserted on Case Management Conferences.

Page 76. Discusses oral testimony at a hearing and the required Witness List.

Page 253. Attorneys fees used to be awarded based on need and ability to pay. Now based upon a finding of a disparity in access to funds and that one party has the ability to pay for attorney services for both parties.
